New York

Southeast

Virginia

Virginia enacted SB 903 effective July 1, 2023, capping retail hemp products at 0.3% total THC and 2 mg total THC per package, with an exception for products meeting a 25:1 CBD-to-THC ratio. North Carolina

North Carolina permits hemp-derived Delta-8, Delta-9, THCa, and CBD under the 2018 Farm Bill and Session Law 2022-32. The state Senate passed HB 328 (“Regulate Hemp-Derived Consumables”) 35 to 7 on June 19, 2025, which would impose a 21+ age limit, packaging rules, and lab-testing requirements pending final House action. South Carolina

South Carolina has not passed a statutory ban on Delta-8 or THCa, but the South Carolina Attorney General issued an opinion in 2023 interpreting Delta-8 and THCa concentrates as controlled substances under state law. The state Senate passed SB 137 in March 2026, which would restrict hemp THC products to adults 21 and older and cap beverages and gummies at 10 mg THC per serving (House action pending). Georgia

Georgia SB 494 (signed by Gov. Brian Kemp on April 30, 2024) restructured the state’s hemp law. Effective October 1, 2024, Georgia uses a total THC formula: (THCA × 0.877) + Delta-9 THC must be 0.3% or less by dry weight. SB 494 also restricts retail sale of unprocessed hemp flower and codifies a statewide 21+ purchase requirement. Florida

Florida hemp products remain legal under the 2018 Farm Bill and Florida Statute § 581.217. Gov. Ron DeSantis vetoed SB 1698 in June 2024, which would have banned Delta-8 and capped products at 5 mg per serving and 50 mg per package. Follow-up bills in the 2025 Florida session did not pass. Tennessee’s hemp regulatory framework changed materially in 2025. HB 1376 (signed by Gov. Midwest

Ohio

Ohio became the 24th adult-use cannabis state when Issue 2 passed November 7, 2023; recreational sales began August 6, 2024. SB 56 (signed by Gov. Mike DeWine in December 2025) caps adult-use flower at 35% THC, caps extracts at 70%, and routes most intoxicating hemp products into licensed dispensary channels. Illinois

Wisconsin has no adult-use cannabis program and no medical cannabis program. Texas

Texas SB 3 (which would have banned hemp THC products) was vetoed by Gov. Greg Abbott on June 22, 2025. A separate Texas Department of State Health Services rule restricting hemp products took effect March 31, 2026. On May 1, 2026, Travis County Judge Daniella DeSeta Lyttle granted a temporary injunction allowing THCa sales statewide through the July 27, 2026 hearing. Austin, Texas

Austin voters passed Proposition A in May 2022 with 85% support, directing Austin Police Department not to cite or arrest for low-level marijuana possession. California

What Changes November 12, 2026

The federal appropriations package signed November 12, 2025 redefines hemp using a total THC standard rather than Delta-9 alone, with the change taking effect November 12, 2026. Under the new definition, THCa flower at typical retail potencies (15 to 25% THCa) would no longer meet the federal hemp definition once decarboxylated.
